Who this is

capragrowth.com and PresenceHQ are operated by Capra Growth LLC, a Texas limited liability company based in Austin, Texas ("we," "us"). By using the site, the scorecard, or PresenceHQ, you agree to these terms. If you don't agree, please don't use them.

Client work has its own agreement

Marketing services are provided under a separate written proposal or agreement with each client. That agreement covers scope, fees, and payment terms. Where it conflicts with these terms, the agreement wins.

The free scorecard and audits

The Local Presence Scorecard and any free audit we prepare are general information about how a business shows up online, based on your answers and on public data at the time we look. They aren't guarantees. Search results, map rankings, and AI assistant answers change constantly and are controlled by Google and other companies, not by us.

Only enter a website you own or have permission to check. The scorecard loads that site's public homepage and runs a speed test on it.

PresenceHQ

• Access is by invitation. PresenceHQ is provided to clients as part of an engagement. Access can end when the engagement does.
• Keep your sign-in to yourself. You're responsible for activity under your account. Tell us right away if you think someone else has used it.
• You authorize what you connect. When you give us access to your Google Business Profile or another account, you confirm you're allowed to, and you authorize us to use that access to provide the service, including publishing posts and photos and replying to reviews on your business's behalf when you or we write or approve them in PresenceHQ. You can withdraw it at any time. How we handle that data is in our Privacy Policy.
• Your data stays yours. Your business's information belongs to you. The PresenceHQ software, reports' design, and this website's content belong to Capra Growth LLC.

Review requests

If you use PresenceHQ to ask your customers for reviews, you confirm you have their permission to contact them, including by text message, and that you won't offer anything in exchange for a review or ask only happy customers. Google, Yelp, and the law all prohibit both.

Fair use

Don't use the site, the scorecard, or PresenceHQ to break the law, attack or overload our systems, scrape them, get into accounts that aren't yours, or scan websites you don't have permission to check. We may block access that does.

Other companies' services

Parts of what we do depend on services run by other companies, such as Google, which have their own terms. When those companies change their products, rules, or data, what we can show or do may change too. We aren't responsible for their services.

No guarantees

The site, the scorecard, and PresenceHQ are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We work hard to get things right, but we can't promise uninterrupted service, error-free data, or any particular ranking, review count, lead volume, or revenue.

Limits on liability

To the fullest extent the law allows, Capra Growth LLC isn't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the site, the scorecard, or PresenceHQ. For the free site and scorecard, our total liability is limited to $100. For PresenceHQ, it's limited to the fees you paid us in the three months before the claim.

Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be handled in the state or federal courts located in Travis County, Texas.

Changes to these terms

If these terms change, this page changes with them, and the "last updated" date at the top will tell you when. Using the site or PresenceHQ after a change means you accept the updated terms.
